Procedure
- Record chain: CS → SA → RS → BS/City jorip khatiyans in sequence; every break in the chain is a finding. Mutation (namjari) + DCR + current khajna receipts verified.
- Instrument review: each registered deed — parties' capacity, schedule consistency
(dag/khatiyan/mouza), stamp/registration sufficiency, POA validity (Power of Attorney
Act 2012 — registered irrevocable POA rules
[verify]). - Encumbrance & litigation sweep: registered mortgages (NEC search 12+ years), lis
pendens, acquisition (LA case) status, waqf/debutter character, vested-property
history (Vested Properties Return Act 2001 lineage
[verify]). - Risk classification: GREEN clean chain / YELLOW curable defects (listed with cure steps) / RED possession-title mismatch, ceiling breach, forged-record indicators — RED always escalates per profile.
- Pre-emption exposure: co-sharer/adjoining-owner rights (SAT s.96 as amended 2006 —
agricultural; NAT s.24 — non-agricultural) with current limitation windows
(double-compute dates; see
references/limitation-periods.md).
Output: memo with chain table, defect schedule, cure plan, and closing-condition list.
Guardrails
Never certify title — only enumerate findings for attorney sign-off. Physical possession
and local enquiry cannot be verified from documents; always flag as unverified. Cite
nothing marked [Repealed] in references/repealed-statutes.md.
