Case Prep — Bangladesh Courts
Config gate (portfolio defaults, venue, counsel panel) + root guardrails. Read
references/courts-and-adr.md and references/limitation-periods.md before anything.
Intake sequence
- Limitation first, always. Run /bd-litigation-legal:limitation-check logic before any strategy talk. A brilliant case that is time-barred is a malpractice event. Government defendant → s.80 CPC notice (2 months) into the runway.
- Forum selection.
- Exclusive statutory forums trump the CPC: bank/FI money claims → Money Loan Court (Artha Rin Adalat Ain 2003); worker claims → Labour Court; tax → appeals ladder then Tribunal then HCD reference; company disputes (winding up, rectification) → HCD Company Bench; cyber offences → Cyber Tribunal.
- Arbitration clause present? → s.10 Arbitration Act 2001 (stay of legal proceedings); decide invoke-vs-waive strategically and flag the choice.
- Regulatory action with no efficacious remedy → writ (Art. 102) — faster but discretionary; laches applies; disputed facts kill writs.
- Venue per CPC ss.16–20 and any jurisdiction clause (validity rules in courts-and-adr.md). State the court by name and tier (pecuniary limits — verify current Civil Courts Act figures).
- Chronology + evidence map. Dated event table with source documents; mark which documents are (a) original vs copy (Evidence Act 1872 primary/secondary rules), (b) digital (2022 amendment admits electronic records — note authentication needs), (c) unstamped/unregistered (admissibility exposure, Stamp Act s.35).
- Interim relief assessment: injunction (Specific Relief Act ss.52–57; O.XXXIX CPC), attachment before judgment (O.XXXVIII), arbitration interim measures (s.7A).
- Procedural roadmap: plaint/WS timelines, court-annexed mediation stage (CPC ss.89A), discovery limits (interrogatories/inspection under CPC — narrow by common-law standards; manage client expectations), realistic duration by forum, execution strategy at the end (O.XXI — plan enforcement before filing, not after decree).
Output
Attorney-review draft: forum & venue memo (cited), limitation certificate with the computed bar date, chronology table, evidence map with admissibility flags, interim-relief recommendation, roadmap with the next three deadlines, settlement/ADR posture per config, escalations (constitutional questions, contempt exposure, cross-border enforcement, criminal-colour disputes — cheating/CBT complaints as leverage raise ethics issues, flag).
