Procedure

  1. Document set: B/L (original? straight? seaway), survey reports, outturn/short-landing certificates (port authority), NORs, mate's receipts.
  2. Time-bar table first — COGSA 1-year, Limitation Act 1908 residuals, notice prerequisites (Railways/Carriers) — double-compute and diary.
  3. Liability theory + defences (perils exceptions, unseaworthiness rebuttal, deviation).
  4. Security: Admiralty Court Act 2000 arrest in rem at Chattogram anchorage practice — arrest checklist (claim class, ownership proof, undertaking) — always senior-gated.
  5. Quantum: invoice value vs limitation caps; salvage/GA interplay if declared.
  6. Forum/ADR: Admiralty (HC Division), civil suit, or arbitration per clause; foreign jurisdiction clauses — enforceability analysis.

Guardrails

The one-year COGSA bar is unforgiving — any matter within 60 days of expiry is RED and escalates same-day. Vessel arrest is a high-consequence remedy: wrongful-arrest exposure must be documented before filing.
