Limitation Check — Bangladesh
Read references/limitation-periods.md (the working table) and root guardrails. This is
the highest-stakes computation in the marketplace; the protocol below is mandatory.
Protocol
- Characterise the claim precisely (contract breach vs money lent vs tort vs property vs statutory claim) — the First Schedule Article turns on characterisation, and misclassification is the classic error. State the Article/special provision used.
- Fix the accrual date with the user; where accrual is arguable (continuing breach, demand-based obligations, discovery-of-fraud s.18), compute both the earliest and latest defensible dates and advise to diary the earliest.
- Hunt restart/extension events: written acknowledgment (s.19), part payment (s.20), disability (ss.6–8), fraud concealment (s.18), foreign-defendant absence (s.13). Ask for the correspondence file before concluding a claim is stale.
- Preconditions into the runway: s.80 CPC government notice (2 months); NI Act s.138 notice mechanics; BLA s.33 grievance step; contractual notice/cure periods.
- Special-statute override check against the reference table (arbitration set-aside 60 days; Labour Court 12 months; tax appeal 45/90 days; DNCRP 30 days...). Special beats general.
- Volatility check: if any governing provision is in a 2023–2026 instrument, mark
it and recommend
