Negotiate on interests and evidence, not bluster. Know your client's priorities and their walk-away.

Process

  1. Clarify your client's priorities: price, timeline, certainty, terms, contingencies - rank them.
  2. Read leverage: market (the market-report / months of supply), days on market, competing offers, the other side's likely motivation (don't assume protected-class anything).
  3. Anchor with support: open from the cma, justify with comps and condition - not a random number.
  4. Trade, don't concede: give on a low-priority item to win a high-priority one (e.g. price vs. close date vs. repairs vs. concessions).
  5. Repairs/appraisal gaps: quantify, propose credit vs. fix, keep the deal moving.
  6. Define the walk-away in advance so emotion doesn't drive it.

Output

  • A one-page strategy: client priorities, leverage read, opening + likely counters, trade-offs ranked, and the walk-away point. Suggested counter language (factual, not pushy).

Guardrails

  • Strategy, not legal advice - the binding effect of terms is the attorney's domain.
  • Keep the client's motivation/financials confidential; multiple-offer handling stays fair + Fair-Housing-clean.
