EEOC Compliance in Driver Hiring

EEOC enforces federal anti-discrimination laws. Driver hiring requires careful compliance to avoid claims.

Title VII protected classes

  • Race
  • Color
  • National origin
  • Religion
  • Sex (including pregnancy, gender identity, sexual orientation)

Other federal anti-discrimination laws

  • ADA — disability
  • ADEA — age (40+)
  • GINA — genetic information
  • Pregnancy Discrimination Act
  • Equal Pay Act

When EEOC applies to your hiring

  • Have 15+ employees (Title VII threshold)
  • Federal contractor (lower threshold may apply)
  • State law may apply at lower employee counts

What's not discriminatory

  • Required physical capability (lifting, sitting, vision)
  • Required license (CDL)
  • Required medical certification (federal mandate)
  • Job-related background check (job-related conviction)

What IS discriminatory

  • Excluding applicants based on protected class
  • Inquiring about protected class in interview
  • Using protected class info to make decisions
