Patent Search Strategy
Search Sources
- USPTO Patent Full-Text Database: US patents and applications
- Espacenet (EPO): worldwide patent coverage
- Google Patents: best for keyword-based initial searches
- Lens.org: open access, cross-database
- PatSnap / Derwent (enterprise): analytics and citation mapping
Search Methodology
- Define the invention in function terms (not your specific implementation)
- Identify: core concept, key components, novel aspects
- Build keyword set: synonyms, technical terms, trade names for each concept
- Search CPC/IPC classifications most relevant to the technology
- Review 50-100 most relevant results for relevance
- Expand search based on cited references and citing patents
Claim Analysis
Claim Hierarchy
- Independent claims: stand alone, define broadest scope, must all be valid
- Dependent claims: narrow the independent claim, easier to defend
Claim Element Analysis
For FTO: infringing product/process must include EVERY element of an independent claim. Missing even one element = no infringement of that claim.
Patent Landscape Analysis
For a technology area, map:
- Key assignees (companies/universities) and their portfolio size
- Filing trend by year: is the space getting crowded or quieting down?
- Most cited patents: foundational prior art (design around or license?)
- White space: technology combinations with few or no filings
- Expiring patents: valuable patents entering public domain
